The term "Witness Only Closing" is somewhat misleading in the state of
Georgia. This is because Georgia is an "Attorney Only" state, which
means that all real estate closings must be witnessed by a licensed attorney
in good standing with the Georgia Bar Association. This proceeds
from the fact that real estate closings are considered transfers of
certain legal rights pertaining to the property being transacted upon,
and as such, must be done under the oversight of a qualified lawyer.
A
more accurate way to differentiate between full and witness only
closings in attorney only states might be by the level of service
provided by the attending attorney. Additional services traditionally
rendered by attorneys overseeing real estate transactions include, but
are not limited to title searches and document preparation, services
not provided by the traditional witness at witness-only closings - a
notary public. Such attorney-assisted closings are referred to as full
closings.
While the need for attorney only closings remains an issue for debate,
there are several important advantages to having an attorney present,
and only one drawback - the cost of an attorney. That's where Middle

providing the kind of service that you expect (and the law requires).
